Merchant Terms of Service

These terms govern your use of FingerPay as a merchant. By creating a merchant account, you agree to these terms. Please read them carefully.
1. The Service
FingerPay ("we", "us", "our") provides a fingerprint-based payment processing platform that allows your customers to pay using their enrolled fingerprint. We are not a bank. Payment processing is handled by Stripe, Inc. under their own terms.
2. Merchant Account
To use FingerPay you must:
- Create a merchant account with accurate business information
- Connect a valid bank account via Stripe Connect to receive payouts
- Keep your API key secure — you are responsible for all activity under your account
- Notify us immediately if you suspect unauthorized access
You may not share your API key with third parties or use it for any purpose other than integrating FingerPay into your own point-of-sale system.
3. Subscription and Billing
FingerPay charges a flat subscription fee of $99 per month per merchant account. This fee covers unlimited transactions — we take no per-transaction cut.
- Free trial: New accounts receive a 60-day free trial. No charge during the trial period.
- Billing: After the trial, your card on file is charged $99 on the same date each month.
- Failed payments: If a payment fails, your subscription enters a past-due state. You have 7 days to update your payment method before access to payment processing may be restricted.
- Cancellation: You may cancel at any time from the merchant dashboard. Your access continues until the end of the current billing period. No refunds for partial months.
We reserve the right to change subscription pricing with 30 days notice by email.
4. Payouts
Customer payments are routed to your connected Stripe account. Payout timing is determined by Stripe's standard payout schedule (typically 2 business days for US accounts). FingerPay does not hold your funds — we are not a payment processor or money transmitter.
5. Your Responsibilities
As a merchant, you are responsible for:
- Obtaining proper consent from your customers before enrolling their fingerprint
- Displaying the FingerPay privacy policy or equivalent disclosure to customers at point of enrollment
- Complying with all applicable laws in your jurisdiction, including biometric data laws (BIPA, CCPA, etc.)
- Only charging customers for legitimate transactions
- Providing refunds to customers where required by law or your own policies
- Maintaining accurate and up-to-date business information in your account
6. Prohibited Uses
You may not use FingerPay to:
- Process payments for illegal goods or services
- Enroll customers without their explicit knowledge and consent
- Charge customers amounts they have not agreed to
- Attempt to reverse-engineer, copy, or resell the FingerPay platform
- Test attacks against the system or attempt unauthorized access
Violation of these prohibitions will result in immediate account termination.
7. Data and Privacy
Customer fingerprint data enrolled through your terminal is stored encrypted on FingerPay's servers. You do not have direct access to raw fingerprint data. Refer to our Privacy Policy for full details on how biometric and payment data is handled.
Upon termination of your account, customer fingerprint data linked to your merchant account is pseudonymized within 30 days.
8. Limitation of Liability
FingerPay is provided "as is." To the fullest extent permitted by law:
- We are not liable for payment failures, Stripe outages, or network disruptions beyond our control
- We are not liable for losses arising from unauthorized use of a stolen API key
- Our total liability to you in any month shall not exceed the subscription fee paid in that month ($99)
9. Termination
Either party may terminate the merchant relationship at any time. We may suspend or terminate your account immediately if you violate these terms, fail to pay, or engage in fraudulent activity. You may cancel via the merchant dashboard at any time.
10. Governing Law
These terms are governed by the laws of the State of Oklahoma, United States. Any disputes shall be resolved in the courts of Oklahoma County, Oklahoma.
11. Changes to These Terms
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of FingerPay after that date constitutes acceptance of the updated terms.
